LIABILITY RELEASE & CONFIDENTAL
INFORMATION AGREEMENT
In consideration of the opportunity to participate as a volunteer at The Action Center, I agree to the following:
1. Confidential Information. I understand that I may have access to sensitive or confidential information, including information about clients, staff, volunteers, donors and financial and business operations. Confidential information can be in any form. At all times during and after my participation, I will not disclose or use any such confidential information except as required by my duties as a volunteer. If I observe access to or sharing of confidential information that is or appears to be unauthorized, I will alert staff.
2. Assumption of Risk. I understand that volunteering at The Action Center involves certain risks, that I may be exposed to personal injury or death, or damage to my property or equipment, that my own safety is my responsibility , and that I can refuse, to do anything with The Action Center that I believe poses a hazard. With knowledge of risks, I agree to accept and assume all risks of personal injury or death, or damage to my property.
3. Release of Liability. I agree that I, my successors, assignees, heirs, insurer, agents, guardians and legal representatives waive and release any rights, actions, or causes of action against The Action Center, its officers, directors, employees, volunteers or people served by The Action Center (the “Released Parties”) for injury, death, loss of use, damages arising or resulting from the acts or omissions of any person, entity or my volunteer activities. This includes, without limitation, negligence of any of the Released Parties, whether active or passive, sole or comparative, or other negligence, however caused, arising from or relating to The Action Center or my participation in any way.
4. Medical Release. I release and forever discharge the Action Center from any claim whatsoever arising or that may arise because of any first aid or medical service including the lack of or timing of such rendered in connection with my participation as a volunteer.
5. Photographic Release. I grant and convey to The Action Center all rights, title, and interest in any and all photographic images and video or audio recordings made by The Action Center while volunteering.
6. In-Kind Policy. Donated items are not allowed to be taken by staff, volunteers or others for personal use unless authorized or as designated in common areas. Volunteers may use the Action Center’s services by following the same procedures used for participants.
7. Other: Volunteer expressly agrees that this Release in intended to be as broad and inclusive as permitted by the laws of the State of Colorado and that this Release shall be governed by and interpreted in accordance with the laws of the State of Colorado. Volunteer agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions which shall continue to be enforceable.
I understand that agreeing to this waiver and release and other terms of this agreement are a requirement for me to volunteer at The Action Center.
I read, understood, and accepted this Agreement.

ACUERDO DE LIBERACIÓN DE RESPONSABILIDAD E INFORMACIÓN CONFIDENCIAL

En consideración a la oportunidad de participar como voluntario en The Action Center, acepto lo siguiente:
1. Información Confidencial. Entiendo que puedo tener acceso a información delicada o confidencial, incluida información sobre clientes, personal, voluntarios, donantes y operaciones comerciales y financieras. La información confidencial puede estar en cualquier forma. En todo momento durante y después de mi participación, no divulgaré ni utilizaré dicha información confidencial, excepto cuando lo requieran mis deberes como voluntario. Si observo el acceso o el intercambio de información confidencial que no está o parece no estar autorizado, alertaré al personal.

2. Asunción de Riesgo. Entiendo que ser voluntario en The Action Center implica ciertos riesgos, que puedo estar expuesto a lesiones personales o la muerte, o daños a mi propiedad, que mi propia seguridad es mi responsabilidad y que puedo negarme a hacer cualquier cosa con The Action Center que creo que representa un peligro. Con conocimiento de los riesgos, acepto y asumo todos los riesgos de lesiones personales o muerte, o daños a mi propiedad.

3. Liberación de responsabilidad. Acepto que yo, mis sucesores, cesionarios, herederos, aseguradora, agentes, tutores y representantes legales renunciamos y liberamos cualquier derecho, acción o causa de acción contra The Action Center, sus funcionarios, directores, empleados, voluntarios o personas atendidas por The Action Center (las “Partes Liberadas”) por lesiones, muerte, pérdida de uso, daños que surjan o resulten de los actos u omisiones de cualquier persona, entidad o mis actividades voluntarias. Esto incluye, sin limitación, la negligencia de cualquiera de las partes exoneradas, ya sea activa o pasiva, única o comparativa, u otra negligencia, cualquiera que sea su causa, que surja o se relacione con The Action Center o mi participación de cualquier manera.

4. Liberación médica. Libero y libero para siempre The Action Center de cualquier reclamo que surja o pueda surgir debido a cualquier servicio médico o de primeros auxilios, incluida la falta o el momento en que se brindó la ayuda en relación con mi participación como voluntario.

5. Publicación fotográfica. Otorgo y transfiero a The Action Center todos los derechos, títulos e intereses en todas y cada una de las imágenes fotográficas y grabaciones de audio o video realizadas por The Action Center mientras era voluntario.

6. Política en especie. Los artículos donados no pueden ser tomados por personal, voluntarios u otras personas para uso personal a menos que estén autorizados o designados en las áreas comunes. Los voluntarios pueden utilizar los servicios de The Action Center siguiendo los mismos procedimientos utilizados para los participantes.

7. Otro: El voluntario acepta expresamente que esta liberación de responsabilidad pretende ser tan amplia e inclusiva como lo permitan las leyes del Estado de Colorado y que esta Liberación de responsabilidades se regirá e interpretará de acuerdo con las leyes del Estado de Colorado. El voluntario acepta que en el caso de que cualquier cláusula o disposición de este Descargo sea declarada inválida por cualquier tribunal de jurisdicción competente, la invalidez de dicha cláusula o disposición no afectará de otra manera las disposiciones restantes que seguirán siendo ejecutables.
Entiendo que aceptar esta renuncia, liberación y otros términos de este acuerdo son un requisito para que yo sea voluntario en The Action Center.
